Los Alamitos, CA

Last month the Environmental Law Foundation (ELF), a California non-profit organization, reported that a number of packaged fruits and juices they tested reported high levels of lead. On June 9th the ELF sent a Notice of Violation Proposition 65 to the CEOs of major fruit processing companies, grocery store chains and other locations where these products are sold or distributed.

According to language in the ELF document that was sent and made public, “This letter constitutes notice that the entities identified in Exhibit A have violated and continue to violate provisions of the Safe Drinking Water and Toxic Enforcement Act of 1986, California Health and Safety Code sections 25249.5 et seq.”

Lead is a material known to the State of California to cause reproductive toxicity and cancer. The specific fruit products tested included apple and grape juice, packaged pears and peaches, and fruit cocktail. A number of the brand name fruit products exceeded the Prop 65 limit of 0.5 micrograms of lead per serving.

Lead is an elemental material and is considered a heavy metal. It is found in nature and has been used by man in numerous manufacturing processes. Lead is a toxic substance to animals, including humans. It can damage the nervous system and cause brain and blood disorders. It is also a neurotoxin that accumulates in animal bones and soft tissues.

LA Testing, an affiliate of EMSL Analytical, is a leading provider of lead testing laboratory services and products to clients across the West Coast. “Lead is of particular concern to young children as their growing bodies can absorb more lead and their brain and nervous systems are more sensitive,” reported Ben Sublasky, National Director of Client Services for LA Testing and EMSL Analytical. “Unborn babies can even be harmed by lead.”
