More reforms surrounding compensation claims

The Government have said that new legislation will be brought in next year to bring greater protection to small businesses and volunteers from negligence claims. These reforms aim to tackle the supposed compensation culture in the UK, in addition to the sweeping changes that have already been made over the last year and a half.

The Lord Chancellor, Chris Grayling, has said the aim of the new legislation is to protect small businesses when it is thought their negligent actions were done for the ‘greater good’. An example of people protected by the changes could include someone who was unwilling to clear a pathway in case this caused ice to form and someone then slipped and suffered injury. It would also protect people who are in the emergency services who are concerned about helping people in case there is a breach in health and safety rules.

Chris Grayling commented on the changes saying “I hope that [the Bill] will finally slay much of the ‘elf and safety’ and jobsworth culture that holds back much of our society. All too often people who are doing the right thing in our society feel constrained by the fear that they are the ones who will end up facing a law suit for negligence”.

As well recent reforms to personal injury claims in 2013 and the proposed changes to whiplash medical panels, there is a fear that these further changes will result in those people who have been seriously injured not being able to claim the compensations they deserve. In their fight against the apparent compensation culture in this country, the Government could have the potential to push things too far and make it even more difficult for victims of accidents to gain access to justice.
